Article 4 (1) from the Regulation, on the declaration of performance, says:
“When a construction product is covered by a harmonised standard or conforms to a European Technical Assessment which has been issued for it, the manufacturer shall draw up a declaration of performance when such a product is placed on the market.”
To harmonised standard level, when a construction product is covered by a harmonised standard whose reference had been published in the Official Journal of the European Union (OJEU), and the coexistent period  is finished, the manufacturer has the obligation to issue a declaration of performance and CE mark the product in accordance with this standard. This obligation applies to put a product
Between 28.02.2019 and 10.06.2019, ITeC has issued three ETA and has a further forty-two in process. The three ETA issued correspond to the following two EAD and ETA Guideline (see the EOTA website, ‘Our Publications’ section).
EAD 090062-00-0404, on kits for external wall claddings mechanically fixed.
ETA 13/0166 Tempio® FK-16 and FK-20 kits with continuous horizontal profiles or discontinuous rails, Tempio® FS-20, FS-24 and FS-30 kits with clips, from Cerámica Mayor SA.
EAD 350140-00-1106, on renderings and rendering kits intended for fire resistant applications.
ETA 18/1087 Biofire from TRIA-Serviços, Materiais e Equipamentos SA.
In addition to EAD 090062-00-0404, ITeC has twelve EAD published in the OJEU and is currently working on a further fourteen, two of which are EAD amendments:
- one has already been internally adopted by EOTA and the corresponding ETA is now under preparation
- the remaining thirteen are at different stages of elaboration
Note: at this point, the conversion works from the ETA Guidelines to EAD indicated in the first item of this section, are not considered.
The three EAD indicated hereafter were developed by ITeC within the EOTA framework and published in the OJEU, on 20.03.2019. They enable the elaboration of ETAs and the CE marking of the kits covered by their scope. ITeC is one of the most active institutes in the kits field, and particularly in that related to façades.
Below, the content of these three EAD is synthetically described. Information on all the EAD drawn up by ITeC can be consulted in the article “Thirteen European Assessment Documents drawn up by ITeC published in the OJEU”.

- Conversion from the ETA Guideline for fire retardant products (ETAG 028):
Once the comments received in the Commission final review were dealt with, the revised document was sent for publication.
- Conversion from the ETA Guideline on prefabricated units for external wall insulation (ETAG 017) – work led by CSTB-ITeC

In this period, the first two Commission Implementing Decisions concerning EADs have been published in the Official Journal of the European Union-OJEU: the Decision 2019/450, on 19.03.2019, and Decision 2019/896, on 28.05.2019, which modifies and widens the first one.

At the Technical Board meeting no. 24, the current status of the fourteen conversions presently in progress was considered.
As indicated in previous Reports four different basic phases can be distinguished in the conversion process from the ETA Guidelines to EAD:
1st Elaboration and adoption by the working group;
At this moment, all conversions are at the third or fourth phase.
At present, there are eighteen EAD published based on ETA Guidelines, of which the modification of one has already been published. From now on, they will be identified by their reference number.
Based on the Commission Communication COM (2018) 764, commented in Report No. 19, the Commission is setting up the following measures to improve the European Assessment Documents-EAD:

In the last EOTA Executive Commission meeting, Mr. Iñigo Urresti from the European Commission, announced that on 18 of January the process for the first publication of EAD references in the OJEU had just begun, applying the new procedure. He also pointed out that this EAD publication will include those EADs from the suspended December publication and some other additional EADs.
According to Mr. Urresti, this EAD publication will help DG Grow to check the new procedure, which is based on 4-5 steps and finishes with the publication of an implementing act in the OJEU, which at the same time will include the EAD list of references. He is not yet in conditions to give a publication date.

The current status of the seventeen conversions presently in progress was considered at the meeting of Technical Board No. 23.

Dated 22.11.2018, the Commission published the Communication COM(2018) 764 ‘Harmonized standards: Enhancing transparency and legal certainty for a fully functioning Single Market’.
This communication explains the actions taken recently by the Commission to further improve the European standardisation system. It also includes specific actions that the Commission will take in the immediate future in order to enhance the efficiency, transparency and legal certainty for the stakeholders involved in the development of harmonized standards. Therefore, it is referred to those European standards adopted on the basis of a Commission’s request for the application of Union harmonization legislation.
Since Regulation 1025/2012 entered into force in 2013, it has provided the main judicial framework in this field, and it comprises the division of responsibilities
What happens to ETA requests for products that do not adjust to the EAD resulting from the conversion of an ETA Guideline?
In principle, two cases can be identified:
In case a), the most appropriate solution is usually to draw up a specific EAD for the product for which an ETA is requested. The TAB receiving the request will develop the EAD in accordance with Annex II of the Regulation, in the same way as all other EADs developed from an individual manufacturer request.
In case b), it is necessary to undertake a modification of the EAD resulting from the conversion of an ETA Guideline. This modification will be developed in
In view of the limited number of ETAs issued and the lack of interest in the sector, conversion of ETA Guidelines 016, 021, 023, 024, 025, 031, 033, 035 into EAD is not envisaged (see the EOTA website). The EOTA has made a commitment to the Commission to finalize the greatest possible number of conversions by the end of 2018, but these ETA Guidelines are not included.
When a manufacturer submits an ETA request related to one of these ETA Guidelines, the Technical Assessment Body-TAB must apply Art. 21 (c) of the Regulation: that is, prepare an EAD in response to this request. This EAD will be drawn up based on the corresponding ETA Guideline and will only contain those aspects
Between 18.10.2018 and 19.12.2018, ITeC issued five ETA and has a further thirty-five in process. The five ETAs issued correspond to the following two EADs and the ETA Guidelines (see the EOTA website, publications section).
As well as the ten EAD already published, ITeC is currently working on a further fifteen:
