Are EAD mandatory?

Article 4 (1) from the Regulation, on the declaration of performance, says:

“When a construction product is covered by a harmonised standard or conforms to a European Technical Assessment which has been issued for it, the manufacturer shall draw up a declaration of performance when such a product is placed on the market.”

To harmonised standard level, when a construction product is covered by a harmonised standard whose reference had been published in the Official Journal of the European Union (OJEU), and the coexistent period [1] is finished, the manufacturer has the obligation to issue a declaration of performance and CE mark the product in accordance with this standard. Elaboration of ETAs

Between 28.02.2019 and 10.06.2019, ITeC has issued three ETA and has a further forty-two in process. The three ETA issued correspond to the following two EAD and ETA Guideline (see the EOTA website, ‘Our Publications’ section).

Elaboration of EADs

In addition to EAD 090062-00-0404, ITeC has twelve EAD published in the OJEU and is currently working on a further fourteen, two of which are EAD amendments:

  • one has already been internally adopted by EOTA and the corresponding ETA is now under preparation
  • the remaining thirteen are at different stages of elaboration

Note: at this point, the conversion works from the ETA Guidelines to EAD indicated in the first item of this section, are not considered.

Published EADs drawn up by ITeC

The three EAD indicated hereafter were developed by ITeC within the EOTA framework and published in the OJEU, on 20.03.2019. They enable the elaboration of ETAs and the CE marking of the kits covered by their scope. ITeC is one of the most active institutes in the kits field, and particularly in that related to façades.

Below, the content of these three EAD is synthetically described. Information on all the EAD drawn up by ITeC can be consulted in the article “Thirteen European Assessment Documents drawn up by ITeC published in the OJEU”.

Publication of EADs in the OJEU

In this period, the first two Commission Implementing Decisions concerning EADs have been published in the Official Journal of the European Union-OJEU: the Decision 2019/450, on 19.03.2019, and Decision 2019/896, on 28.05.2019, which modifies and widens the first one.

Conversions of ETA Guidelines in progress or pending publication

At the Technical Board meeting no. 24, the current status of the fourteen conversions presently in progress was considered.

As indicated in previous Reports four different basic phases can be distinguished in the conversion process from the ETA Guidelines to EAD:

1st Elaboration and adoption by the working group;
2nd Adoption by EOTA – by the designated bodies;
3rd Comments of the Commission – including their consideration;
4th Publication – this may also include the comments of the Commission, in the final review of the EADs;

At this moment, all conversions are at the third or fourth phase.

Conversion of the ETA Guidelines with the EAD published

At present, there are eighteen EAD published based on ETA Guidelines, of which the modification of one has already been published. From now on, they will be identified by their reference number.

Introduction of improvements in European Assessment Documents

Based on the Commission Communication COM (2018) 764, commented in Report No. 19, the Commission is setting up the following measures to improve the European Assessment Documents-EAD:

  1. All references to other harmonised technical specifications, test standards or other reference documents in an EAD, should be accompanied by date (year).
  2. All the assessment methods will be included in the EAD’s text. No Technical Reports (TR) including assessment methods will be created or referred to in the new EADs.
  3. The technical assessment bodies and the EOTA’s secretariat will apply a check list for the adopted EAD drafts, provided by the Commission.
  4. Proliferation of similar EADs is to be avoided, as far as possible.

What does the EAD number mean?

It is structured in three parts: EAD XXYYYY-00-ZZZZ

  • The first part is a combination of the product area code, according to Annex IV of the Regulation, and the project number defined by EOTA.
  • The second part indicates the EAD version. 00 is the initial version, 01 is the first modification, and so on.
  • The third part shows the area of the product according to the EOTA classification.

The EAD is now on publication phase and Commission’s comments have just been received.

  • Conversion from the ETA Guideline on prefabricated units for external wall insulation (ETAG 017) – work led by CSTB-ITeC:

Commission’s consultant’s comments were considered (Commission’s comments phase); the revised EAD and the answers to the comments have been circulated to the designated bodies for confirmation. Commission’s comments have just been received.

Publication of EADs in process with the new procedure announced by the Commission

In the last EOTA Executive Commission meeting, Mr. Iñigo Urresti from the European Commission, announced that on 18 of January the process for the first publication of EAD references in the OJEU had just begun, applying the new procedure.  He also pointed out that this EAD publication will include those EADs from the suspended December publication and some other additional EADs.

According to Mr. Urresti, this EAD publication will help DG Grow to check the new procedure, which is based on 4-5 steps and finishes with the publication of an implementing act in the OJEU, which at the same time will include the EAD list of references. He is not yet in conditions to give a publication date.

Introduction of improvements in the harmonized standards

Dated 22.11.2018, the Commission published the Communication COM(2018) 764  ‘Harmonized standards: Enhancing transparency and legal certainty for a fully functioning Single Market’.

This communication explains the actions taken recently by the Commission to further improve the European standardisation system. It also includes specific actions that the Commission will take in the immediate future in order to enhance the efficiency, transparency and legal certainty for the stakeholders involved in the development of harmonized standards. Therefore, it is referred to those European standards adopted on the basis of a Commission’s request for the application of Union harmonization legislation.

Since Regulation 1025/2012 entered into force in 2013, it has provided the main judicial framework in this field, and it comprises the division of responsibilities

What happens to ETA requests for products that do not adjust to the EAD resulting from the conversion of an ETA Guideline?

In principle, two cases can be identified:

  1. When the divergence results from a specific technical aspect of the product for which an ETA is requested.
  2. When the divergence can be generalized and applies to all similar products in the sector.

In case a), the most appropriate solution is usually to draw up a specific EAD for the product for which an ETA is requested. The TAB receiving the request will develop the EAD in accordance with Annex II of the Regulation, in the same way as all other EADs developed from an individual manufacturer request.

In case b), it is necessary to undertake a modification of the EAD resulting from the conversion of an ETA Guideline. This modification will be developed in

What happens to ETA requests related to ETA Guidelines for which conversion is not expected?

In view of the limited number of ETAs issued and the lack of interest in the sector, conversion of ETA Guidelines 016, 021, 023, 024, 025, 031, 033, 035 into EAD is not envisaged (see the EOTA website). The EOTA has made a commitment to the Commission to finalize the greatest possible number of conversions by the end of 2018, but these ETA Guidelines are not included.

When a manufacturer submits an ETA request related to one of these ETA Guidelines, the Technical Assessment Body-TAB must apply Art. 21 (c) of the Regulation: that is, prepare an EAD in response to this request. This EAD will be drawn up based on the corresponding ETA Guideline and will only contain those aspects

ITeC has now ten EADs published

The references for these EADs have been published in the OJEU, and the corresponding documents on the EOTA website.

Nine have been drawn up as a result of manufacturer ETA requests. The tenth EAD is the result of the conversion of ETA Guideline 034 to an EAD, carried out by an EOTA working group led by ITeC.

After due consideration of the comments of the Commission, the draft EAD has been sent to the Commission for the publication phase.

  • Conversion from the ETA Guideline on prefabricated units for external wall insulation (ETAG 017) – work led by CSTB-ITeC:

Having been adopted by EOTA, the draft EAD was sent for the Commission comments phase. The comments of the EC consultant have been received and will be considered as soon as possible.

New procedure for the publication of EADs

At Technical Board meeting no. 22, Mr Iñigo Urresti, the new deputy director in the DG Grow, announced a new procedure for the publication of EADs. The Commission has decided to apply this new procedure for the publication of harmonized standards as well as for EADs. This decision applies from 1 December 2018. For this reason, the publication of harmonized standards and EADs envisaged for the month of December has been suspended until the new procedure has been implemented.

The introduction of this new procedure results from the sentence in the Elliot case. This procedure will include various steps, such as an inter-service consultation in the Commission, and will conclude with the publication of an Implementation Act. The Commission is at present

Conversion of ETA Guidelines with the EAD published

Since the publication of Report no. 17, two EADs have been published in the OJEU, corresponding to the conversion of ETA Guidelines 027 and 034. There are now fifteen published EADs based on ETA Guidelines.

Almost 90% of the ETA Guidelines conversions have completed the phase of adoption by EOTA

At the beginning of 2018, EOTA agreed with the Commission to bring forward as far as possible the conversion of priority C ETA Guidelines – whose completion date was set for 15 December 2020 – to the end of 2018 (as with the conversions of priority B Guidelines). This decision affects nineteen ETA Guidelines.

In the process of conversion from ETA Guidelines to EAD, four basic phases can be distinguished:

1 Elaboration and adoption by the working group;
2 Adoption by EOTA – by the designated bodies;
3 Comments by the Commission – including their consideration;
4 Publication – this may also include the comments of the Commission, in the final revision of the EADs;

Publication of the support study for review of the Regulation

The reports on this study have now been published. This study comprises two reports: the report for the Regulation assessment and the report for the Regulation impact assessment. The first one gathers the evidence to evaluate the Regulation by means of a retrospective analysis of its functioning and the objectives reached. The second one evaluates the potential options for its future revision.

Both reports are composed of the final report, a number of annexes and a summary for executives, which can be obtained either from the Commission Website or from the Publications Office of the Commission.

This is an external study for the Commission developed by: the Joint Institute for Innovation Policy (JIIP), Valdani Vicari & Associati (VVA), the Danish Technological Institute

What is the difference between a kit and an assembled system within the framework of the Construction Products Regulation?

A ventilated façade is composed of a set of components that are ‘assembled’ on site, the result being an assembled system. A kit for a ventilated façade is a construction product marked by a manufacturer for the execution of a façade assembled system. See the article ‘The kit concept in construction products’.

Each kit consists of a set of components that may correspond either to a part of the components of the assembled system – e.g. the cladding element and the cladding fixings on a ventilated façade -, or in some cases to the entire assembled system – e.g. the cladding element and the cladding fixings, the subframe and the subframe fixings, and the insulation, in the previous example.
